Types of Nikah in Shariah


In shariah terminology, nikah means bringing a woman into the contract of marriage with whom there is no shari prohibition, so that sexual satisfaction can be attained through halal means.  

Nikah is an act of worship that has continued from abul bashar adam alayhissalam until today, and this practice will continue even in jannah. It is also the continuous sunnah of the prophets alayhimus salam.  


*Fard*:  

If a person is overwhelmed by desire to such an extent that if he does not marry he will certainly fall into zina, and he also has actual or potential ability to provide necessary maintenance and mahr, then it is fard upon him sharan to marry and protect his chastity. Durre mukhtar, 3/6  


*Wajib*:  

If a person is dominated by desire such that if he does not marry there is fear of falling into zina, but not certainty, and he also has the ability to provide for the wife’s food and maintenance, then it is wajib upon such a person to marry and protect his chastity. Durre mukhtar, 3/6  


*Types of Nikah - 3*  


*Sunnah*:  

If a person has reached marriageable age, has the ability to provide maintenance, has the ability for intimacy, and there is no other shari obstacle to marriage, then for such a person to live an honorable life through marriage is masnoon sharan. Because this was the constant practice of rasulullah sallallahu alaihi wasallam, and he refuted those who turned away from marriage. So if such a person marries with the intention of following the sunnah, protecting his chastity, and seeking righteous offspring, he will be deserving of reward. Durre mukhtar, 7/3  


*Haram*:  

If a person does not have the capacity to fulfill the rights of a wife, for example he is impotent, or is actually or potentially unable to provide maintenance, or due to harsh temperament etc he is certain that he cannot fulfill the wife’s rights, then marriage is haram for such a person. Durre mukhtar, 7/3  


*Makrooh Tehrimi*:  

If a person is not certain that he will oppress his wife but his dominant assumption is that oppression will occur, then until he gains the ability to fulfill rights, marriage is makrooh tehrimi for him. Durre mukhtar, 7/3  


*Mubah*:  

If a person fears he will be deficient in fulfilling marital rights, but does not have certainty or dominant assumption of it, then marriage is mubah for him. Shaami, 7/3
