Nikah with a Hindu Woman is Not Permissible

Nikah of a muslim man is haram with any mushrik, idolater, or follower of hinduism, sikhism, buddhism etc, as long as she does not properly accept deen-e-islam and become muslim. For a muslim, nikah with them is never permissible.  

"And do not marry mushrik women until they believe." Surah al-baqrah, 221  

*Nikah with a Non-Muslim Man is Haram*  

The permissibility of nikah with a kitabiya woman is established with certain conditions, details of which have passed earlier. But the nikah of any muslim woman with a non-muslim man, whether he is a kitabiya or non-kitabiya, is not halal in any situation. Therefore it is necessary to be very mindful of this. Ba-hawala hindiya, bidaya  

*Ruling on Nikah with a Qadyani Woman*  

Hazrat muhammad mustafa sallallahu alaihi wasallam is the final prophet of allah ta'ala. No new nabi will come after him. Whoever claims prophethood after him will be a liar. Holding this belief is farz on all muslims.  

Therefore the claim of prophethood by mirza ghulam ahmad qadyani is false. In this claim he denied all those clear texts of quran and hadith by which the belief of khatm-e-nabuwwat is established.  

Hence mirza ghulam ahmad qadyani is murtad, kafir, out of the fold of islam. Now whoever accepts mirza ghulam as a prophet is also out of the fold of islam.  

Therefore establishing a nikah relationship with him is not permissible. Giving him a daughter or bringing his daughter into one's nikah, both are haram.  

*Nikah with Shia Woman and Man*  

A person who believes in the divinity of hazrat ali raziyallahu anhu, or considers the quran kareem to be altered, or accuses ummul momineen hazrat aayesha raziyallahu anha of zina, or denies the companionship of hazrat abu bakr siddiq raziyallahu anhu, or holds the belief that hazrat jibra'il alaihissalam made a mistake in bringing wahi, or holds any other disbelieving belief, he is kafir, out of the fold of islam.  

Therefore if any shia girl holds these beliefs, then nikah of a sunni muslim with her is not halal.  
If she does not hold disbelieving beliefs, then in itself the nikah will be concluded, but still there is a greater risk of the man's belief being corrupted by marrying her, so it is necessary to avoid it. Ba-hawala durre mukhtar, 3/46, al bahrur ra'iq, 3/121  

If any shia holds disbelieving beliefs, then the nikah of a sunni girl with him will not be concluded because he is kafir.  
And if he does not hold disbelieving beliefs, then he is still an innovator and fasiq. Nikah of that sunni girl cannot take place because due to being fasiq he is not kufu for the sunni girl. Aalamgiri, 1/kitabun nikah  

*Acceptance of Islam by a Non-Muslim and His/Her Nikah*  

If any kafira woman accepts islam, then if she is such that she has no husband, nikah with her is valid immediately.  
If her husband is present, then the ruling is that if he also becomes muslim, then as before this woman will remain his wife, both their nikah remains intact.  
If the husband refuses to accept islam, then separation be done between them. This separation will be by the ruling of talaaq.  

If this woman is in darul harb, then her nikah will end after three haiz pass from the time of accepting islam. If pregnant, her nikah will end upon delivery. After that she should observe iddat and then marry. This is more cautious. Ba-hawala durre mukhtar, 3/188  

If the woman accepts islam and migrates from darul harb to darul islam, her nikah will end immediately upon entering darul islam. There is difference of opinion on the obligation of iddat upon her, the view of obligation is stronger and more cautious. Ba-hawala durre mukhtar, 3/193
