Equality in Nikah
In the shariah of muhammad sallallahu alaihi wasallam, the purpose of nikah is to live together for life as husband and wife and to increase the human race.
For this it is necessary that there be love between the couple and compatibility in both their temperaments.
For this reason the pure shariah has commanded that equality in kufu be considered in nikah.
Rasulullah sallallahu alaihi wasallam said, "Marry women only in kufu, conduct their marriage in the presence of their wali, and do not fix their mahr less than ten dirhams." Bayhqi
Equality is mostly seen in 5 things:
1. Lineage, 2. Islam, 3. Religiosity, 4. Wealth, 5. Profession
*1. Equality in Lineage*
Equality in lineage means that sheikh, sayyad, pathan, mughal, ansari, all are equal to each other.
Meaning although the rank of sayyad is higher than others, if a sayyad girl marries into a sheikh family, it will not be said that equality was not maintained. Sharah bidaya, 2/300
*Equality in Being Muslim*
A person who himself became muslim but his father was kafir is not equal to a woman who herself is muslim and her father is also muslim.
And a person who himself is muslim and his father is also muslim but his grandfather was not muslim, is not equal to a woman whose grandfather is also muslim.
If his father and grandfather are both muslim but great-grandfather was not muslim, then that person will be considered equal to a woman whose several generations are muslim.
The summary is that equality is considered up to the grandfather in being muslim, after that equality in great-grandfather and great-great-grandfather is not necessary. Aalamgiri, 1/301,310
*Equality in Religiosity*
Equality in religiosity means that a person who is not observant of deen, is a rogue, drunkard and immoral, will not be considered equal to a righteous pious religious woman. Fatawa aalamgeeri, 1/310
*Equality in Wealth*
Equality in wealth means that a completely destitute needy person is not equal to a wealthy woman.
And if he is not completely destitute but can give as much mahr as is customary to give on the first night and can provide maintenance, then he is of her match and equal even if he cannot give the entire mahr. And it is not necessary that he be as wealthy as the girl's family or nearly as wealthy. Fatawa aalamgiri, 2/299
*Equality in Profession*
Equality in profession means that weavers and tailors are a match and equal to each other. Similarly washermen etc are also not equal to tailors. Sharah tanveer, 1/190
An insane mad man is not a match for an intelligent and sensible woman. Ba-hawala durre mukhtar, 2/531
